This Privacy Policy ("Policy") sets out the manner in which Astroculture Services Private Limited, a company incorporated under the Companies Act, 2013 and having its registered office at Hanto Virgo Building, #185/A, 22nd Cross, 3rd Sector, HSR Layout, Bangalore560102 Karnataka India ("Company", “MyNaksh”, "we", "us", or "our"), collects, uses, discloses, processes, and protects your information through your use of our astrology service platform accessible via our website https://mynaksh.com/ and related mobile applications (collectively, the "Platform"). The terms "you" and "your" in this Policy refer to individuals who access the Platform and/or any Services.

PLEASE READ THIS POLICY CAREFULLY.

Save and except where required by applicable laws, we will separately obtain your consent before collecting or processing particular categories of personal information or using your information for particular purposes, by accessing or using the Platform or any services made available through it (“Services”), you acknowledge that you have read, understood, and agreed to the terms of this Policy. You explicitly consent to the collection, processing, transfer, storage, and/ or use of your information, in accordance with the provisions of this Policy. If you do not agree, you must refrain from using the Platform and Services.

Our Services use artificial intelligence ("AI") and automated technologies to generate astrological charts, readings, predictions, interpretations, recommendations, conversational responses and other personalised content based on information provided by You.

By clicking on the “I Accept”, “Agree”, or similar button, checkbox, or mechanism, or by otherwise accessing or using the Platform you:
(i). acknowledge receipt of this notice issued under applicable laws;
(ii). confirm that you have read and understood this Policy, including the manner in which data will be processed;
(iii). expressly agrees to be bound by the terms of this Policy; and
(iv). provides consent to the processing of personal data by the Company in accordance with this Policy and applicable laws.

POLICY CHANGES/ UPDATION

We reserve the right to update this Policy from time to time. Any material changes will be communicated to you through the Platform or by email (if available). Your continued use of the Platform after the revised Policy is posted shall constitute your acceptance of the updated policy .

INFORMATION WE COLLECT

Depending on how you use the Services on the Platform, we may collect the following categories of information:

1. Information you provide directly :

   1. Name,
   2. contact details,
   3. date of birth,
   4. gender,
   5. marital or relationship status (if voluntarily provided),
   6. login credentials; and
   7. Birth details (date, time, and place) and other information you voluntarily provide for astrological readings or consultations.

   If you provide information about another individual, you should only provide information that you are authorised to provide and that is reasonably necessary to use the relevant Service.

2. When You interact with our AI-powered astrology features, we may collect :

   1. User-submitted questions or requests for consultations;
   2. Chat and conversation history;
   3. AI generated responses and reports;
   4. Communications between you and the astrologers, consultants or customer support; and
   5. Feedback, reviews, or queries submitted via the Platform or customer support.

   Your conversations may contain highly personal information. For example, users may voluntarily ask questions concerning relationships, family, career, finances, pregnancy, health, religion, sexuality or other private matters. Please avoid providing information that is not necessary to receive the Service, including Social Security numbers, government identification numbers, passwords, complete financial account information, medical records or other highly sensitive credentials or documents.

3. Device, Technical and Usage Information:

   1. IP address;
   2. browser type;
   3. device ID;
   4. mobile network;
   5. operating system;
   6. Referring pages; and
   7. Application crashes

4. Information generated or Inferred by our AI systems

   1. astrological charts and classifications;
   2. horoscope or zodiac information;
   3. interests and preferences;
   4. relationship or compatibility insights;
   5. conversational context;
   6. topics in which you appear interested; and
   7. other predictions, classifications or inferences used to personalise your experience.

5. Location information subject to app or device settings;

6. Platform usage data, including interaction patterns, log data, session frequency, and preferences; You may disable location permissions through your device settings, although certain Platform features may then be unavailable.

7. Payment Information:

   If you make payments on the Platform or purchase Services through the Platform, payments may be processed by third party payment processors. We may receive transaction related information , such as:

   1. transaction ID,
   2. Amount;
   3. Currency;
   4. Subscription status (if any);
   5. Payment status; and
   6. Limited information regarding payment methods used;.

   We do not ordinarily collect or store complete payment card numbers, CVVs or similar authentication information. Sensitive financial information (e.g., CVV, full card number) is collected and processed directly by the payment gateway and is also subject to its own privacy policy and terms. .

8. Sensitive Data

   Since you can communicate freely with our AI astrology assistant, conversations may contain information that qualifies as "sensitive personal information" or "sensitive data" under applicable U.S. state privacy laws. Depending on applicable law, this may include information revealing:

   • racial or ethnic origin;
   • religious or philosophical beliefs;
   • health information;
   • sexual orientation or sexual activity;
   • citizenship or immigration status;
   • precise geolocation;
   • biometric information; or
   • other legally protected characteristics.

   We ask that you only provide sensitive information where reasonably necessary for the Service you request. Where applicable law requires affirmative consent before we process sensitive personal information, we will request such consent separately. We do not use sensitive information disclosed in private astrology conversations for targeted advertising.

PURPOSE OF COLLECTION AND USE

Your personal information may be used by us for the following purposes, including:

1. To create, authenticate and maintain your account;
2. To provide personalised astrological content, forecasts, and reports;
3. To improve the accuracy and quality of the Services;
4. To enable enabling consultations and communications with astrologers (AI and non-AI based) or other service providers;
5. To respond to your queries or requests;
6. To analyse usage and improve Platform functionality;
7. To generate and review reports and data about, and to conduct research on, our user base and Platform usage patterns;
8. To measure or understand the effectiveness of advertising we serve to you and others, and to deliver relevant advertising to you, if any;
9. To personalise your experience on the Platform;
10. troubleshooting technical issues and preventing fraud, abuse and security incidents;
11. To send promotional communications where permitted by applicable law and subject to your marketing preferences;
12. To display or measure advertising, where applicable and subject to applicable privacy rights and choices;
13. To process transactions and maintain transaction records;
14. To enforce our terms of services and protecting rights, safety and security of the Platform; and
15. To comply with applicable laws and enforce legal rights.

We will not process personal information for a materially different purpose that is incompatible with the purposes disclosed to you without providing any notice or obtaining any consent required under applicable law.

ANONYMISATION OF DATA

We may anonymize and/or de-identify information collected from you through the Platform or via other means, including via the use of third-party web analytic tools. Where information has been de-identified so that it cannot reasonably be linked to you, we may use such information for research, analytics, product development, statistical analysis and other lawful business purposes.Where required by applicable law, we will maintain de-identified information in de-identified form and will not attempt to re-identify it except as permitted by law. As a result, our use and disclosure of aggregated and/or de-identified information is not restricted by this Privacy Policy, and it may be used and disclosed to others without limitation. We analyse the log files of our Platform that may contain IP addresses, browser type and language, internet service provider (ISP), referring, app crashes, page viewed and exit websites and applications, operating system, date/time stamp, and clickstream data. This helps us to administer the website, to learn about user behaviour on the site, to improve our product and services, and to gather demographic information about our user base as a whole. We may provide advertisers with reports about the kinds of people seeing their ads and how their ads are performing, but we don't share information that personally identifies you (information such as your name or email address that by itself can be used to contact you or identifies who you are) unless you give us permission.

USE BY AI SYSTEMS OF YOUR INFORMATION

Our Platform uses AI systems, which may include machine-learning models, large language models, algorithms and other automated technologies. When you submit a question or request, relevant information may be provided to our AI systems to generate a response. Depending on the functionality being used, this information may include:

• your question or prompt;
• birth details;
• relevant astrological calculations;
• relevant portions of previous conversations;
• profile preferences; and
• other information necessary to generate the requested response.

AI-generated outputs may also be stored as part of your conversation history where applicable.

USE OF INFORMATION FOR AI AND MACHINE LEARNING

We do not use the content of your identifiable private astrology conversations to train general-purpose AI models unless we clearly disclose such use and obtain any consent required by applicable law. We may use limited information to operate, secure, test and evaluate our Services, including detecting technical errors, abuse or unsafe AI outputs. Where possible, we use aggregated or de-identified information for analytics, evaluation and product improvement.

HUMAN REVIEW OF AI INFORMATION

In limited circumstances, authorised personnel or service providers may review AI interactions where reasonably necessary to:

• investigate technical problems;
• respond to customer support requests;
• investigate suspected fraud or abuse;
• evaluate AI quality or safety;
• investigate reports of harmful or inappropriate outputs; or
• comply with legal requirements.

Access to user conversations is restricted to personnel who require access for an authorised purpose and is subject to appropriate confidentiality, access-control and security requirements. Where feasible, information used for broader quality evaluation will be de-identified or otherwise minimised.

DISCLOSURE OF INFORMATION

We may share, disclose or transfer your information that we collect for the following purposes:

1. To third-party service providers engaged by us for cloud hosting, technical, customer support, analytics, cyber security, payment processing, or marketing;

2. To legal or regulatory authorities where required under applicable law, lawful government request, court orders, legal proceedings or to protect the rights, safety or security of MyNaksh, users or others ;

3. To our affiliates in India or outside India who may use, store, transfer, process, disclose for the same purposes as provided in this Policy;

4. Subject to applicable laws, to advertisers and advertising networks to display and measure ads on the Platform or elsewhere, provided that no personally identifiable information is shared without your consent and appropriate safeguards are in place; We do not disclose the content of your private AI astrology conversations to advertising partners for targeted advertising. Certain advertising-related disclosures may nevertheless constitute a "sale," "sharing," or processing for "targeted advertising" under U.S. state privacy laws. Where applicable, you may opt out as per the provisions of this Policy.

5. In connection with a merger, acquisition, reorganisation, or sale of assets;

6. AI and Model Providers: Information necessary to process an AI request may be transmitted to third-party AI/model providers where they provide technology used by the Platform. We contractually restrict providers processing personal information on our behalf from using such information for purposes unrelated to providing their contracted services, subject to applicable law and the applicable service arrangement.

7. To fulfil the purpose for which you provide it.

We also do not disclose private AI conversation content to third parties for cross-context behavioural or targeted advertising.

We may share your information other than as described in this Policy if we notify you and you consent to the sharing.

COOKIES

The Platform uses cookies, SDKs, pixels, local storage and similar technologies for authentication, security, platform functionality, to enhance user experience, analyse trends, performance measurement and administration of the Platform. You may control/manage the use of cookies through your browser settings. However, disabling cookies may affect some functionalities of the Platform.

We do not intentionally configure advertising or analytics technologies to collect the contents of private AI astrology conversations.

DATA RETENTION

We will retain your personal information only for as long as necessary to fulfil the purposes outlined in this Policy or as required by applicable law.

Non-personal or anonymised data may be retained indefinitely for research or analytical purposes. Where technically and legally feasible, information will be deleted or de-identified when it is no longer required. Information contained in backups may remain for a limited period until the relevant backup is overwritten or securely deleted.

INTERNATIONAL DATA TRANSFERS

The Company is established in India. If you use the Platform any jurisdiction other than India , your personal information may be transferred to, stored in or processed in India and other jurisdictions in which our affiliates, cloud-service providers, payment processors, analytics providers, AI technology providers and other service providers operate. Privacy laws in these jurisdictions may differ from those applicable where you live. We implement reasonable contractual, organisational and technical measures designed to protect personal information processed internationally in accordance with applicable law.

SECURITY MEASURES

We implement appropriate and reasonable technical and organisational safeguards designed to protect your personal data/information from unauthorised access, disclosure, or misuse. However, no electronic transmission or storage method is fully secure, and we cannot guarantee absolute security.

Depending on the nature of the information and relevant risks, safeguards may include:

• encryption;
• access controls;
• authentication;
• logging and monitoring;
• secure software development practices;
• vendor security requirements; and
• incident response procedures.

No electronic system can be guaranteed to be completely secure.

CHILDREN'S PRIVACY

Our Services are not intended to be independently accessed or used by anyone who has not attained the age of majority as per the relevant applicable laws that govern such individuals. However, it is not possible for us to prevent certain users, including children, from fraudulently representing their age in order to gain access to the Platform.

A parent or legal guardian may, through the parent’s or guardian’s own Account, provide limited information relating to their child, such as the child’s name, date, time and place of birth, for the purpose of requesting an astrological report or other Service concerning the child. Before submitting such information, the parent or legal guardian must confirm that they have the legal authority to provide the information and give any verifiable parental or guardian consent required under Applicable Law. The parent or legal guardian will remain responsible for the Account and for all requests made in relation to the child.

We will process a child’s information only for the purposes described in this Privacy Policy and the relevant Service request. We will not knowingly permit a child to interact directly with the Service or use the child’s information for targeted advertising or behavioural monitoring where prohibited by Applicable Law. If we learn that a child’s information was provided without the required parental or guardian authorisation, please contact us at help@mynaksh.com, and we will take appropriate steps to restrict or delete the information, subject to Applicable Law and any applicable record-retention obligations.

YOUR RIGHTS

Subject to applicable law, you may have the following rights:

1. Right to access, updation/correction of your personal information provided to us;
2. Right to withdraw or decline to provide information;
3. Right to request for deletion of your personal information. Upon receipt and confirmation of your request for deletion, we will delete your personal data or information from our records. However, we shall also reserve the right to discontinue the services for which the information was originally collected. Please note that we may have to retain such personal data or information if required under applicable laws and regulations; fraud prevention; to maintain archives; to enforce rights under this Privacy Policy and terms of service

Subject to applicable laws, when you sign up for an account, you are opting in to receive messages, push notifications, emails and other marketing communications from MyNaksh. You may follow the “unsubscribe” instructions in commercial email messages to opt-out. Please note that you cannot opt out of receiving certain administrative notices, service notices, transactional messages such as OTP or legal notices from MyNaksh.

If you are accessing or using the Services from the United States of America, depending on your state of residence and subject to applicable law and exceptions, you may have the right to:

1. know or access personal information we process about you;
2. obtain a copy of certain personal information;
3. correct inaccurate personal information;
4. delete certain personal information;
5. opt out of sale or sharing;
6. opt out of targeted advertising;
7. opt out of certain qualifying profiling;
8. limit certain uses of sensitive personal information;
9. withdraw consent where processing depends upon consent;
10. appeal certain decisions concerning a privacy request; and
11. exercise your rights without unlawful discrimination.

YOUR OBLIGATIONS

You shall provide complete and accurate information when consenting to its processing. If any information is incorrect, you shall bear all costs incurred if such information affects or limits their rights and interests. You shall comply with applicable laws on personal data protection and participate in preventing and combating violations of personal data protection regulations.
